Being 0.823 of an acre of land, more or less, out of and a part of that certain 16.4 acre tract and that certain 8.2 acre tract lying and being in the I.D. Thomas Survey, Abstract No. 73, Polk County, Texas, said 16.4 acre tract being the same land conveyed by that certain partition deed of the Reuben Bogany heirs to Jim Bogany and wife, Hattie Bogany, dated October 12, 1907, recorded in Volume 50, page 311, and said 8.2 acre tract being the same land conveyed by Albert (Dock) Bogany to Jim Bogany by deed dated August 31, 1940, recorded in Volume 119, page 251, Deed Records of Polk County, Texas; said 0.823 of an acre parcel of land being more particularly described as follows:   
      BEING a strip of land, including the existing county road commonly known as the Goodrich - New Hope road, 100 feet wide, 50 on either side of the proposed FM Highway 2969 centerline, extending from Engineer’s centerline station 82/11 to Engineer’s centerline station 88/27; said proposed centerline being described as follows:
       BEGINNING at a point in the said existing county road on the easterly boundary line of said Jim Bogany property, said point being located in a 4 degree 00’ curve to the right and identified as Engineer’s Station 82/11;
      THENCE around said curve, having a central angle of 12 degrees 00’, to the P.T. of said curve at Engineer’s Station 82/93.94;
    THENCE around said curve, having a central angle of 21 degrees 34’, along said proposed centerline to intersection with the boundary line between Jim Bogany property and Smith Wright at Engineer’s Station 88/27;
        Said strip of land containing a total of 1.414 acres of land of which 0.591 of an acre is contained with the limits of county road leaving a net total of 0.823 of an acre of land, more or less, required for additional right of way.
